This Seller Agreement (“Agreement”) sets out the terms under which you (“Seller”) may list and sell products through the Hawk & Peddle online marketplace (“Platform”).
By applying to become a seller, creating a seller account, or listing products on the Platform, you agree to be bound by the terms of this Agreement.

“Hawk & Peddle”, “we”, “us” and “our” refer to Hawk & Peddle (business entity details to be inserted).


1. About the marketplace

Hawk & Peddle is a curated online marketplace connecting customers with independent creators, designers and small businesses.
We act as:

  • A platform provider

  • A marketing and promotional channel

2. Eligibility to sell

To become a Seller on Hawk & Peddle, you must:

3. Your responsibilities as a Seller

You must:

  • Ensure products are safe, legal and compliant with UK trading laws

  • Dispatch orders within the processing time stated on your listings

  • Provide tracking for orders over £30 where applicable

  • Respond to customer enquiries within 3 working days

  • Handle returns in line with UK consumer law and our Returns Policy

  • Keep your seller account information up to date

  • Fulfil all orders in a professional and timely manner

 

4. Product listings

You agree that:

  • Your listings must be accurate, honest and not misleading.

  • You must clearly state when items are made-to-order, custom, or non-returnable.

  • You must include correct size guides, materials, processing times and stock levels.

  • You will not list products that infringe copyright, trademarks or other IP rights.

  • You will not upload offensive, harmful or unsafe products.

Hawk & Peddle may remove listings that violate platform standards or legal requirements.

 


5. Orders, fulfilment and delivery

You must:

  • Dispatch orders within the processing time you have set

  • Use reliable couriers

  • Package items securely

  • Provide accurate tracking information when required

  • Notify us immediately of delays

  • Not include marketing materials encouraging customers to shop off-platform

If you repeatedly fail to dispatch on time, we may:

  • Temporarily hide your listings

  • Suspend your seller account

  • Remove you from the marketplace

6. Returns, refunds and customer service

You must comply with UK consumer law.

Mandatory Refund Obligations

You must accept returns for:

  • Faulty items

  • Items not as described

You must:

Non-Faulty Returns

7. Payments to Sellers

Hawk & Peddle collects customer payments on your behalf.

9. Customer data and privacy (UK GDPR)

You must:

  • Only use customer data for fulfilling the order

  • Never add customers to mailing lists without explicit consent

  • Never share, sell or misuse customer information

  • Store and process customer data securely

You must comply with:

If you mishandle customer data, we will immediately suspend your account.

 


10. Intellectual Property

You confirm that:

  • You own or have permission to use all images, descriptions and designs you upload

  • Your products do not infringe third-party intellectual property

  • You grant Hawk & Peddle a licence to use your images and descriptions to market your products

This licence is non-exclusive and revocable upon termination.

 


11. Prohibited items

You may not sell:

  • Weapons

  • Counterfeit items

  • Unsafe or non-compliant goods

  • Offensive or harmful content

  • Items banned under UK law

  • Items violating copyright or trademark laws

We will remove prohibited items without notice.

 


12. Account suspension or removal

We will suspend or remove a seller for:

  • Repeated late dispatches

  • Poor product quality

  • Non-compliance with UK consumer law

  • Ignoring customer messages

  • Misuse of customer data

  • Fraudulent or unsafe behaviour

  • IP infringement

  • Any action that harms customers or the platform

13. Hawk & Peddle’s rights

  • Promote sellers or products at our discretion

  • Remove listings

  • Resolve disputes between customers and sellers

  • Refund customers directly if required

  • Enforce marketplace policies

We are not liable for your business losses or operational costs.

 


14. Termination

Either party may terminate this Agreement with 14 days’ notice.
Upon termination:

  • All listings will be removed

  • Outstanding orders must still be fulfilled

  • Refund obligations still apply

  • Outstanding debts/fees must be paid

 


15. Governing law

This Agreement is governed by the laws of England and Wales.
Any disputes will be resolved in UK courts.

 


16. Acceptance

By listing products on Hawk & Peddle, you confirm you have read, understood and agreed to this Seller Agreement.

Hawk & Peddle is a curated online marketplace that connects customers with independent creators, designers and small businesses. This policy explains how returns and refunds work when you purchase through www.hawkandpeddle.co.uk.

Because we operate as a marketplace, some products are sold and fulfilled directly by independent sellers. In all cases, your legal rights as a UK consumer remain fully protected. This policy follows the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 (“distance selling rules”).


1. Who is responsible for returns?

Products sold by Hawk & Peddle directly

Some products (including many print-on-demand items) are created and fulfilled by Hawk & Peddle or our fulfilment partners.
For these items, Hawk & Peddle manages returns and refunds directly.

Products sold by independent sellers

Each seller on the marketplace is responsible for the quality, fulfilment and returns of their own products.
However:

  • Hawk & Peddle oversees the process

  • We intervene if a seller fails to meet UK consumer law

You will always have someone to contact, and your rights are protected.


2. Your right to cancel (cooling-off period)

Under UK law, you may cancel certain online purchases within 14 days of receiving the goods, without giving a reason.

  • Made-to-order items

  • Personalised goods

  • Digital downloads once accessed

  • Perishable items

Because many Hawk & Peddle and marketplace-seller products are made to order (including most clothing, accessories, prints, and home décor), the cooling-off period may not apply unless stated otherwise by the seller.

3. Faulty, damaged or incorrect items (always covered)

Regardless of who the seller is, you always have the right to a replacement or refund if an item arrives:

  • Damaged

  • Not as described

  • Not what you ordered

Your responsibilities:

4. Non-faulty returns

For items sold by Hawk & Peddle

For items sold by marketplace sellers

Each seller may have their own returns policy in addition to UK consumer law.

If the seller accepts non-faulty returns, you must:

  • Ensure it is unused, unworn and in original packaging
